Terms of service

These terms govern enquiries about and use of Flashvue — fundraising games for clubs and charities. Operator draft — replace after counsel review. These are not FCOS plan terms.

This agreement is entered into between:

  • The Publisher: Gary Sheehan, registered under SIREN 833289754, headquartered at 936 Route de Douzains, Lalandusse, 47330, publisher of Flashvue.
  • The Organisation: any club, charity, or other legal entity applying for or using Flashvue fundraising.

These terms govern the Flashvue marketing site and, once approved, access to Flashvue games and competition tools. They do not govern FCOS club-plan subscriptions. FCOS has its own terms. FCOS Terms

2. Service description

  • Flashvue provides fundraising games (including Spotty and Flip) and related competition tools for approved organisations.
  • Availability: the Publisher strives to keep the service available, except during scheduled maintenance or disruptions beyond its reasonable control. Uninterrupted 24/7 availability is not guaranteed.
  • Updates: the Publisher may deploy updates or bug fixes without prior notice, taking reasonable care to limit unnecessary disruption.
  • FCOS: optional. Football clubs that use FCOS may open Flashvue from the FCOS portal and reuse a Stripe account connected on FCOS. That does not merge the two products or these terms with FCOS terms.

3. Apply & access

  • There is no open self-serve signup on this marketing site. Access is provided after the Publisher reviews an application and approves it, or after an eligible FCOS club uses the portal launch path.
  • The Publisher may approve or decline an application at its discretion, without obligation to give detailed reasons, except where law requires otherwise.
  • The Organisation must have lawful authority to fundraise for the stated cause and to run the competition in the relevant territory.

4. Organisation obligations & acceptable use

The Organisation agrees to use the service in good faith and in compliance with applicable laws, including gambling, lottery, advertising, and fundraising rules that apply to it.

It is strictly forbidden to:

  • Use Flashvue to host, display, or distribute illegal, defamatory, abusive, or infringing content
  • Attempt to breach, compromise, or overload the security or integrity of the Flashvue infrastructure
  • Misrepresent the organisation’s identity or the destination of funds
  • Resell or sublicense access without prior written authorisation

The Organisation remains responsible for competition rules it publishes, prize fulfilment, and the accuracy of information shown to players.

5. Payments

  • Player payments for competitions are processed by the payment provider used for that organisation (typically Stripe). The Organisation is responsible for its payment account, KYC, and payouts.
  • These terms do not set FCOS club-plan prices. Flashvue fundraising is a separate product.
  • Taxes, fees, and chargebacks are the Organisation’s responsibility except where mandatory law says otherwise.

6. Data protection

Flashvue processes personal data in accordance with the GDPR and applicable national data protection laws. Details are in the Privacy policy.

Club operating-system data on FCOS is governed by FCOS privacy and terms, not this document.

7. Limitation of liability

  • The Publisher shall not be held liable for indirect damages, lost profits, loss of data, or operational interruptions suffered by the Organisation, to the extent permitted by law.
  • The Publisher is not liable for competition outcomes, prize disputes, or fundraising results.
  • Nothing in these terms limits liability that cannot be limited under applicable French law.

8. Governing law & jurisdiction

These Terms are governed by and construed in accordance with French law. Any dispute arising from their interpretation or performance that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Commercial Court of Agen, subject to mandatory rules of jurisdiction that may apply.

We may update these terms from time to time. The “Last updated” date at the foot of this page will change; continued use after reasonable notice constitutes acceptance of the updated terms where permitted by law.
